TERMS & CONDITIONS
FriendsToRent maintains an online platform that allows its members to find other members with the same or similar interests. These Terms and Conditions govern the relationship between members and FriendsToRent.
FriendsToRent is the legal property of Crain Crazy Inspirations Consulting AG, Lavaterstrasse 57, 8002 Zurich, Switzerland.
1. By completing the registration process you agree to the legal and binding agreement with the following conditions:
In addition to FriendsToRent being subsequently used in this Agreement, the terms "we", “our” "us" and "Crain AG" have the same meaning.
2. Minors
Members under 18 years of age are specifically required to share with their parents or guardian the identity of, and any appointments with, unfamiliar people, thereby firstly gaining their consent, see safety recommendations.
3. Registration / service range
Registration is free. As a member you have the possibility to use some but not all the services of FriendsToRent. For the use of all services and features you need to become a fee-paying ** member.
** During the beta phase membership and usage of all FriendsToRent services is free of charge. Upon completion of the beta phase, a membership fee model will be introduced. The information concerning the introduction of the membership fee model will be provided two months in advance. If you decide the cost of membership is too expensive for you, you can cancel your membership during the beta phase without incurring any costs.
Service Offer
FriendsToRent allows you to establish a contact with other members. Each member can decide for himself or herself whether his or her time should be made available for free or for a payment. Each member is free to determine the price, the currency, the payment period and the various payment options (bank, check, bar, etc.) for the service(s) being offered. FriendsToRent is solely responsible for the technical and functional maintenance of the internet platform www.friendstorent.com and expressly excludes any other liability. FriendsToRent is in no case a contracting partner between members and in all events takes no responsibility or liability for the observance of agreed deadlines or other agreements between its members.
FriendsToRent does not provide a matchmaking service and accepts no commitment or guarantee for the successful contracting between members.
The FriendsToRent "FTR-newsletter” informs you regularly on important FriendsToRent features and services and forms an integral part of the FriendsToRent membership. Members may cancel all other newsletters in the category settings.
Periodic payment of such charges
During the duration of the beta phase all services are free of charge. During this period we are reviewing, with FriendsToRent members’ involvement, various bonus and billing models that are both fair and motivating to its members.
4. Cancellation of this agreement
As long as no bonus and billing system is introduced, i.e. as long as all services of FriendsToRent are provided free of charge, you may terminate this agreement at any time without notice to FriendsToRent simply by deleting your profile.
Should you violate this agreement, i.e. not respect the rules described in the TERMS & CONDITIONS, FriendsToRent is entitled at any time to terminate your access to the FriendsToRent services and your membership. For serious breaches of this agreement, the termination shall take place without prior warning.
FriendsToRent has the right to cancel membership for those members whose accounts are inactive for periods of 6 months or longer (calculated from the date of last usage). This does not apply to paying members.
5. Use by the members
FriendsToRent may be used for private commercial purposes, but not for professional and commercial purposes.
5.1 Private commercial purposes:
FriendsToRent members can earn money by offering their time in return for money.
Activities / occupations (examples):
Going to the cinema, theatre, concerts, dining out, playing football, tennis, golf, hiking, biking, horseback riding, helping with household chores and gardening, providing education or instruction, etc.
NB: Earning money above a statutory threshold even in your spare time is usually still subject to taxation. Please find out from your local tax office how much are the tax free thresholds and annual tax levels.
5.2. Professional and commercial purposes not permitted:
- Dating
- Matchmaking
- The arrangement and provision of erotic services
- Placement and exchange of sexual services
FriendsToRent is intended solely for personal membership. Organizations, companies or other entities are not allowed to become members, use these services or offer their services.
6. Publication of content, unwanted content and prohibited content
6.1 The information that you publish on FriendsToRent must be accurate and in accordance with the truth.
6.2 With the exception of information regarded by FriendsToRent as confidential, under the Privacy Policy conditions, all other material that you upload to FriendsToRent as non-confidential and in the public domain will be published by FriendsToRent.
6.3 FriendsToRent can check messages, chat, comments, photos, videos and profiles (collectively, "Content") and remove anything that violates the provisions of this Agreement because it is either illegal or violates, restricts or threatens the rights, safety or honour of others.
6.4 You yourself are responsible for the content that you publish on FriendsToRent and you ensure that this published content is at all times correct and does not infringe the rights of this agreement nor violate the rights of other persons.
6.5 Below are listed the content and activities that are not allowed on FriendsToRent and their publication or other such related illegal acts will result in sanctions (this list is not exhaustive):
6.5.1 Any insulting comments from other members or third parties, whose statements include content pertaining to the following: racism, hatred, bigotry, threats of physical or mental violence, calling for violation against human dignity, (the glorification of violence, paedophilia, etc.) and against the dignity of flora or fauna (cruelty to animals, arson, etc.).
6.5.2 Any defamatory, slanderous or libellous comments about an individual. Initiating or forwarding of "junk mail," "chain letters" or other unsolicited bulk or commercial emails (spam).
6.5.3 The dissemination of knowingly false or misleading information, or abusive, defamatory, libellous or threatening communication that promotes illegal activities or promotes war.
6.5.4 The publishing or calling for the publication of illegal, pirated copies or unauthorized copyrighted materials and links to them, this also includes information which serves, instructs or calls for the evasion of copyright protection.
6.5.5 Calling, organizing or instruction leading to sexual acts with persons under 18 years of age or publishing content with sexual images, or the dissemination of information or links to such content.
6.5.6 The publishing of confidential information of other members or third persons, such as passwords, home addresses, phone numbers, email addresses, etc.
6.5.7 The collection of member data for commercial use and / or sale and the dissemination of information relating to gambling, lotteries, contests, sweepstakes, barter, advertising, and pyramid schemes.
6.5.8 It is recommended that members of FriendsToRent protect their personal identity by not publishing or making public their personal information such as first name, last name, address, URLs or email addresses. In addition, it is not permitted to use information and services from FriendsToRent to harass another person, cause them harm or to advertise to them. To protect our members from such harmful contacts FriendsToRent reserves the right to limit to a reasonable and appropriate number all electronic interactions, such as emails, within any 24 hours which a member may send to another member.
6.5.9 In order to protect its members against malware (viruses, worms, spy software, etc.) and for security reasons the inclusion of links on FriendsToRent is not permitted.
6.6 Prohibited activities. FriendsToRent reserves the right to examine any membership and terminate those who are in violation with any of the previously described regulations, are abusing the service or we feel are in any other way behaving inappropriately or illegally. The following is a non-exhaustive list of actions and behaviours that are undesirable or illegal and will lead to sanctions:
6.6.1 The use of FriendsToRent to provide sexual services of any kind is not permitted. The provision of sexual services will lead to the immediate cancellation of members' accounts. Payments will not be refunded.
6.6.2 The impersonation of another person or identity is not allowed. This is not referring to the nickname, but the faking of an actual identity by impersonating a real existing or not existing person.
6.6.3 It is not allowed to harass or bully other people / members.
6.6.4 It is not allowed to pose as employees of FriendsToRent.
6.6.5 It is not permitted to use automatic search page devices, spiders or other similar techniques, whether automatic or manual to "carry out data mining".
6.6.6 It is not allowed to copy in any way the navigational structure of the FriendsToRent Service nor the representation of its contents.
6.6.7 It is not allowed to distribute or use in connection with FriendsToRent any trademarks, designs, logos, music, video, text, or other copyright protected material or immaterial goods without obtaining the prior written consent of the copyright holder.
6.6.8 It is not allowed to dispatch by e-mail, or any other part of the FriendsToRent platform, a software virus or other computer codes, files, or programs that destroy, disrupt or limit the functioning of or the functionality of any computer software or hardware or television broadcasting, telecommunications, electricity or wireless network.
6.6.9 It is not allowed to reflect in any way parts of, or the entire FriendsToRent service, without first gaining the express written permission of FriendsToRent / Crain AG.
6.6.10 It is not allowed to use FriendsToRent services to plan and execute activities that are irregular, or can be qualified as criminal or which have violated the relevant country-specific laws, or do not conform with the respective national or international legislation.
6.6.11 FriendsToRent members are not allowed to reveal on FriendsToRent or in any other form the identity of other members or clients.
7. Secure Accounts
Each member is personally responsible for maintaining the confidentiality of their user name and password, as well as the activities performed under it. You undertake to (a) immediately inform FriendsToRent when you notice an unauthorized use of your password and user name, or a similar cross-check security breach (b) ensure that you terminate the FriendsToRent service each time correctly using the "logout" function. Use the "logout” function strictly every time you cancel your access to FriendsToRent on a desktop, laptop or mobile device, even if only for a short period of time.
8. Customer Service
FriendsToRent helps its members through customer service. Obscene, threatening, harassing, sexist, racist or offensive behaviour can result in immediate termination of membership. In such a case FriendsToRent reserves the right to claim any payments or part thereof for the related administrative expenses such as the reporting and deletion of the account and to take any necessary safety precautions or investigative measures.
9. Copyright
It is not allowed to send, distribute or otherwise use any copyright-protected brands, designs, music, video, text, images or other material or immaterial items in connection with FriendsToRent without obtaining the prior written consent of the copyright holder.
10. Member Disputes
The FriendsToRent members are responsible for their contacts and offline activities with other members. Disputes between members can lead to a non-binding FriendsToRent observation by staff.
11. Privacy
In using the FriendsToRent service you hereby agree to adhere to the FriendsToRent privacy policy.
12. Access to service
FriendsToRent strives to ensure a 24-hour availability of its website and services. FriendsToRent provides support but with it comes no warranty or guarantee. Access to the FriendsToRent site, its services and features may be temporarily suspended without warning due to maintenance, repairs, system failures or for reasons beyond our control.
13. Warranty Exclusion / Disclaimer
The FriendsToRent website, contents and services are provided "as is" and without warranties or guarantees of any kind. FriendsToRent provides no guarantee for the accuracy or reliability of any statements, opinions, advice, or any other information inside or outside (online or offline) the service; including third parties such as partners, members or other persons, institution or organizations being displayed, uploaded or published. Note that any confidence in such expressions, opinions, advice, member profiles, explanations, information or references to another website (URL) is done at the members’ own risk. FriendsToRent is not responsible for the online or offline behaviour of its members. Use common sense when using the FriendsToRent services, especially when you do not known or trust people, be extra careful when giving out your off line identity and meeting face-to-face; see safety recommendations.
14. Limitation of Liability
FriendsToRent's liability is generally limited to gross negligence or wilful misconduct. Liability is excluded in cases when any third party, including any linked website, directly or indirectly causes damages; see the Privacy Policy.
15. Amendments to this Agreement
FriendsToRent is entitled to supplement and amend these terms and conditions and FriendsToRent is obliged to inform you of any such amendments. If you do not agree with these amendments you have the right to cancel your previous agreement with FriendsToRent. If no notice is given by you, then the agreement with the new conditions will continue.
16. Ownership of Rights
Crain AG / FriendsToRent is the holder and owner of all property including the name, designs, layouts, logos, services, features and programming of FriendsToRent. FriendsToRent has worldwide copyright protection in its entirety and for any components of its content, all rights reserved. It is not allowed to edit, copy, publish or transmit parts of FriendsToRent or FriendsToRent in its entirety, unless FriendsToRent grants you this by express prior permission.
17. Exemption
In the event that you have the right or reason to bring action against another member due to their use of FriendsToRent or the FriendsToRent services, this is a matter for yourself to take up independently and FriendsToRent remains free from any liability relating to any legal damages in connection with the claim or complaint. Furthermore, you exempt FriendsToRent from any third-party claims, including any cost implications such as legal costs and income replacement, which are levied against us due to your misconduct within or outside of the FriendsToRent service. In particular FriendsToRent is not responsible or liable for the due payments of any taxes or funds required by your tax authority or other public administration bodies, in connection with this FriendsToRent is not responsible or liable for any fines and expenditures for legal proceedings, etc.
18. Jurisdiction
This agreement is governed by Swiss law. With this agreement you agree to the jurisdiction of Zurich. We ask you to address complaints concerning the FriendsToRent services to our customer service department.
19. Final Provisions
These terms and conditions of FriendsToRent are stored and made available on the web site http://www.friendstorent.com.
